About the contest
Switching to outdoor electric power tools is all about your personal journey! Participate in Tri-State's photo caption contest on Facebook, launching March 7, for a chance to win awesome electric power tools. A new photo will be posted every Tuesday in March. Participants can comment as many times as they like on the post for a chance to win the electric item in that image. Caption entries must be positive and correspond with the theme of the image. Negative comments will be removed. Two winners will be selected from each photo. Scroll to the bottom to learn more about the contest and electric tools.

Who Can Participate:
Individuals must live within the service territory of a Tri-State member system and receive service from a Tri-State member system. Participants must be 18 years of age or older as of the date of entry, or 19 years of age or older if a resident of Nebraska.
Your local electric cooperative or public power district is a good resource to understand more about this technology, and can help answer questions on contractors, financing, and incentives for energy-efficient options. OFFICIAL RULES FOR THE MARCH 2023 YOUR FUTURE YOUR WAY ELECTRIFICATION GIVEAWAY CONTEST (“ RULES”) BY
TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST .
- Eligibility: This March 2023 Your Future Your Way Electrification Giveaway - Astronaut Electrification Photo Caption Contest (“ Contest”) - is open only to those individuals who are a member/end consumer of one of Tri-State Generation and Transmission Association, Inc.’s, (“ Tri-State”) member systems (a list of Tri-State’s member systems is available here: Member List | Tri-State Generation and Transmission Association, Inc (tristate.coop) ) , which means the individual must live within the service territory of a Tri-State member system and receive electricity from a Tri-State member system in Colorado, Nebraska, New Mexico or Wyoming, and in both cases is 18 years of age as of the date of entry (or 19 years of age if a resident of Nebraska). This Contest is void where prohibited by law. Notwithstanding the above, employees and directors of Tri-State and the immediate family members and/or those living in the same household of Tri-State employees and directors are not eligible to participate in this Contest. In addition, the employees and board of directors/trustees of any of Tri-State’s members systems and immediate family members and/or those living in the same household of Tri-State member systems employees and board of directors/trustees are not eligible to participate in this Contest. Tri-State, in its sole discretion, will determine if an individual is eligible to participate in this Contest. This Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
- Agreement to Rules: By participating, the contestant (“ You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements set forth above. In addition, You agree to accept the decisions of Tri-State as final and binding as it relates to the content and administration of this Contest.
- How to Enter: This Contest must be entered by submitting an entry (a caption) using the comment function below a Contest photo posted by Tri-State as part of this Contest on Tri-State’s Facebook page at Tri-State G&T - Home | Facebook . Each week during the Contest Period (defined below), Tri-State will post a Contest photo on Tri-State’s Facebook page of an electric tool pictured with an astronaut. The day Tri-State posts such photo may be different each week and will be determined by Tri-State, in its sole discretion. There will be a total of 4 photos posted by Tri-State as part of this Contest during the Contest Period. You are entered into this Contest by submitting a caption to the applicable Contest photo posted by Tri-State. You may enter more than one entry (caption) per photo. Any entry (caption) that is vulgar, violent, offensive, negative, sexually explicit, harassing, derogatory, discriminating, or disparaging of Tri-State or Tri-State’s member systems is void and will not be considered, as determined by Tri-State in its sole discretion.
- Contest Period: Entries for this Contest will be accepted online starting on the date the first photo is posted by Tri-State during the first full week in March 2023 and ending March 31, 2023 MT (“Contest Period”). An entry (a caption) for a specific photo posted by Tri-State must be submitted by 10am the day following the day that Tri-State posted such photo (“ Submittal Deadline”). For example, if Tri-State posts the photo at 9:00 AM MT on Tuesday, the Submittal Deadline is 10 AM MT on Wednesday. After such time period, no entry submitted will be considered for such photo. Tri-State’s clock is the official clock for the purpose of this Contest.
- Prizes: Each winner of one of the two best captions for a photo posted by Tri-State as part of this Contest (the “Winner”) will receive the electric tool pictured with the astronaut for such photo, subject to geographical limitations described below. There will be a total of eight (8) winners – two winners for each photo. The specifics of the prize shall be solely determined by Tri-State. No cash or other prize substitution shall be permitted except at Tri-State’s sole discretion. The prize is nontransferable. The retail value of the prizes are estimated to be between $199 and $450 depending on the electric tool prize. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. Winner agrees to provide all information necessary for issuance of a form 1099-MISC in accordance with IRS instructions, if applicable. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Tri-State to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.
- Odds: The odds of winning depend on the number of eligible entries received.
- Winner Selection and Notification: The two winners for each photo will be selected by a vote of at least three Tri-State employees that report directly or indirectly to Tri-State’s Vice President, Communications and may include Tri-State’s Vice President, Communications (“Selection Committee”). The Selection Committee will evaluate each valid entry/caption for the photo based upon originality, humor, and creativity. The Selection Committee will vote on the two best captions for each photo. If a majority vote by the Selection Committee is not received for the two best captions for a photo, a second vote by the Selection Committee for the best captions for the photo with occur with only those captions that were selected during the first vote considered. The Selection Committee will also take into account the state the individual that submitted the valid entry/caption is located with the objective of the Contest for two winners to be selected from each of the following four states during the Contest Period: Colorado, Nebraska, New Mexico, and Wyoming. However, the selection of two winners from each of the above four states will depend on the number of valid entry/captions from each state for each photo. For the determination of the two best captions for each photo and depending on (a) the states the individuals that submitted the valid entry/caption are located and (b) if two prior winners have already been selected for such state, the Selection Committee may only consider, or select the Winner, from valid entry/caption from states that do not already have two winners. The Selection Committee may determine the state the individual that submitted the valid entry/caption is located based upon information on such individual’s Facebook page. Tri-State does not commit, warranty or guarantee that two winners will be selected from each of the four states. All decisions of the Selection Committee are final and binding. The eligible employees on the Selection Committee will be selected by Tri-State, in its sole discretion, and the Selection Committee may be different for each photo. Each preliminary Winner will be contacted by Tri-State through Facebook messenger to verify such preliminary Winner is a member/end consumer of one of Tri-State’s member systems promptly after the Submittal Deadline. Tri-State will strive to contact the preliminary Winner within seventy-two (72) hours after the Submittal Deadline. Tri-State will direct the preliminary Winner on how to verify the preliminary Winner is eligible for the prize and to coordinate shipping of the prize to the Winner. Such verification will include providing to Tri-State a recent copy of such individual’s electric bill from one of Tri-State’s member systems. A preliminary Winner must respond to Tri-State and provide a copy of its electric bill within twenty-four (24) hours from the time Tri-State first contacts the preliminary Winner. Tri-State shall have no liability for Winner’s failure to receive notification that it is the preliminary Winner or for Winner’s incorrect or otherwise non-functioning equipment or contact information. If Winner is ineligible, fails to respond within twenty-four (24) hours from the time Tri-State first contacts the preliminary Winner, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Tri-State may announce the verified Winner on Tri-State’s Facebook page. Tri-State will promptly ship, at its expense, the verified Winner the prize, but only to the service address of the Winner where the Winner receives electricity from a Tri-State member system . Tri-State will select the manner of shipping the prize and is not responsible and not required to fix, return, or replace the prize if damaged or lost during shipping or if the prize arrives in non-functioning condition. Receipt by Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE RULES BY WINNER (AT TRI-STATE‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THIS CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
- Rights Granted by You: By entering this Contest, You understand and agree that Tri-State, anyone acting on behalf of Tri-State, and Tri-State’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your caption/entry submitted, name, portrait, picture, likeness, image, location, statements about this Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent. By entering this Contest, You represent and warrant that your caption/entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your caption/entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Tri-State. If the content of your caption/entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Tri-State from and against any suit, proceeding, claims, liability, loss, damage, costs or expense which Tri-State may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
- Terms & Conditions: Tri-State reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest for any reason and at any time and without notice. Tri-State reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of this Contest or website or violates these Rules. Tri-State has the right, in its sole discretion, to delete, hide, or remove any caption/entry and not consider such entry for any reason, including, but not limited to: vulgar, violent, offensive, negative, sexually explicit, harassing, derogatory, discriminating, or disparaging of Tri-State or Tri-State’s member systems. Any attempt by You to deliberately damage any website or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, Tri-State reserves the right to seek damages to the fullest extent permitted by law. Prizes are awarded "as is" with no warranty or guarantee, either express or implied, by Tri-State. Unclaimed prizes will not be awarded. If a prize becomes unavailable for any reason, Tri-State reserves the right to substitute the prize with another prize of equal or greater value. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
- Limitation of Liability: BY ENTERING, YOU AGREE TO RELEASE AND HOLD HARMLESS TRI-STATE AND ITS SUBSIDIARIES, AFFILIATES, REPRESENTATIVES, AGENTS, MEMBER SYSTEMS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS, AND DIRECTORS FROM ANY LIABILITY, ILLNESS, INJURY, DEATH, LOSS, LITIGATION, CLAIM, OR DAMAGE THAT MAY OCCUR, DIRECTLY OR INDIRECTLY, WHETHER CAUSED BY NEGLIGENCE OR NOT, FROM: (I) YOUR PARTICIPATION IN THIS CONTEST AND/OR YOUR ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE OR ANY PORTION THEREOF; (II) TECHNICAL FAILURES OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE MALFUNCTION OF ANY COMPUTER, CABLE, NETWORK, HARDWARE, OR SOFTWARE, OR OTHER MECHANICAL EQUIPMENT; (III) THE UNAVAILABILITY OR INACCESSIBILITY OF ANY TRANSMISSIONS, TELEPHONE, OR INTERNET SERVICE; (IV) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THIS CONTEST; (V) ELECTRONIC OR HUMAN ERROR IN THE ADMINISTRATION OF THIS CONTEST OR THE PROCESSING OF ENTRIES. Tri-State is not responsible and not required to fix, return, or replace any prize that is damaged or lost.
- Disputes: THIS Contest IS GOVERNED BY THE LAWS OF THE STATE OF COLORADO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, You agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Adams County, Colorado. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees.
