(August 14, 2026, Westminster, Colo.) The Federal Energy Regulatory Commission (FERC) today approved Tri-State Generation and Transmission Association’s High-Impact Load Tariff and Agreement (HILT), subject to Tri-State making a compliance filing within 30 days clarifying how Tri-State will process certain HIL agreements specific to members in the Eastern Interconnect.
Tri-State intends to promptly submit a filing, which would help ensure a repeatable, transparent, and fair process for incorporating high-impact loads.
“Our efforts are designed to protect our cooperative and public power district members. It also will help to drive economic development across our member systems, manage the risks of large load growth and meet regulatory requirements. We intend to pursue this compliance filing for our members,” said Tri-State CEO Duane Highley.
HILT would apply to load additions that exceed 45 megawatts (MW) at the time of a Tri-State member’s HILT project request or are forecasted to exceed 45 MW within four years from the time of the request. The proposed agreement also includes provisions such as a security payment, a minimum term, minimum monthly demand and energy charges, and further defines how members may bring their own resources to serve these loads in conjunction with Tri-State’s pre-existing Bring Your Own Resource tariff.
Tri-State developed HILT with its utility members and industry input and support, to reasonably accommodate the economic benefits that high-impact loads may provide to its utility members’ communities, consistent with Tri-State’s mission of supplying reliable, affordable and responsible electricity to its membership.
